The elements
Civil contempt requires a valid order, knowledge of it, the ability to comply, and a failure to comply. The key fight is almost always ability to pay.
Build the payment chart
Pull the State Disbursement Unit (SDU) history and build a chart showing each month's obligation, posted payments with dates, running arrears, and accrued interest — with the gaps highlighted.
Proving ability — or inability
- Seeking enforcement: paystubs, bank deposits, and lifestyle evidence (travel, purchases).
- Defending: layoff notices, reduced-hour schedules, medical restrictions, unemployment records, and a documented job search.
Purge conditions
Courts often set specific steps to "purge" contempt: a lump-sum payment, an added arrears installment, automated withholding or ACH, and a 60–90-day review to verify progress.
What to bring — and what to avoid
Bring the orders, SDU statements, paystubs, receipts for support add-ons, and any prior payment plans. Avoid the common pitfalls: skipping the hearing, making unsupported claims, or promising a purge plan you can't meet. Because jail is possible, due process applies and counsel may be appointed.
