Serving the Other Parent: Methods & Proof

No valid service, no valid order. Getting notice right — and proving it — protects everything that follows.

The methods

• Personal service by a process server or sheriff
• Substituted service (leaving papers with a competent adult, then mailing a copy)
• Certified mail with return receipt
• Electronic service or publication — only in limited circumstances, with court approval

Set the server up to succeed

Gather the other parent's legal name and aliases, work schedule, vehicle details, and multiple addresses, and share it with the server. File an affidavit of service with the date, time, location, a description of the person served, and the method — and keep the green card or USPS tracking.

When service fails

File a declaration listing every attempt with dates and times; on a showing of reasonable diligence, the court may authorize substituted service, posting, email, or publication. Multi-state and international service means local servers or the Hague Service Convention with translated documents through a Central Authority. Serve 15–30 days before the hearing, calendar from the service date, and never attempt self-service.
