Average, then structure
Courts typically average earnings across 12–36 months using tax returns, 1099s, and year-to-date reports, flagging one-time events (a business sale, pandemic overtime) so they don't distort the number. A common structure is base-plus-percentage: a base tied to predictable income plus a percentage of variable pay — for example, $600 a month plus 10% of gross commissions over $3,000, paid within 10 days of receipt.
True up once a year
Add an annual reconciliation using tax documents: if the total paid falls short of the guideline on actual annual income, the obligor pays the difference over six months — which prevents an arrears spike during a slow season.
Document and automate
Keep business and personal accounts separate, deposit all receipts, and provide 1099-K or 1099-NEC forms — hiding income across platforms just invites the court to impute it. Automate with weekly SDU transfers and ACH drafts aligned to commission cycles, and raise withholding in peak months to build a cushion. If the work dries up, file promptly to modify with evidence rather than falling behind.
