Nonparent Caregivers: Grandparents & Guardians

When a grandparent or other relative is raising a child, they can collect support — but they need legal standing first.

Establish standing

An informal arrangement isn't enough. A caregiver needs a guardianship order, a dependency case placing the child with them, or a power of attorney to be recognized as the payee. Both living parents may owe support at once if their rights are intact, and an existing order can be modified to redirect funds to the caregiver.

Benefits, insurance, and closure

Many kinship families receive TANF, SNAP, Medicaid, or foster stipends — collected support may reimburse those programs rather than flow straight to the caregiver, so ask for a written explanation. Put parental health-insurance maintenance and education decision-making authority in the order, keep parent communication in agency channels, and notify the agency immediately when the child returns to a parent so payee information and any arrears get resolved.
