LGBTQ Parents & Gender Considerations

Support law is increasingly gender-neutral — but the way parentage is established still determines everything, so lock it down.

Establish legal parentage

The marital presumption applies gender-neutrally in many states, a Voluntary Acknowledgment of Parentage (VAP) has replaced "paternity" language, and a second-parent adoption or parentage judgment adds security. Gamete donors generally aren't legal parents when the statutes are followed, while intended parents — those who consented to conception planning to raise the child — usually are, even without a genetic tie.

Draft it neutrally

Replace "mother/father" with "Parent A / Parent B" or names, and use role-based language ("the parent with employer insurance shall…") instead of gendered assumptions. Put current legal names on the case caption to prevent payroll and ID mismatches, and ask the SDU to update its records.

Travel and enforcement

Carry certified copies of the order and register it in a new state, and verify that a destination country recognizes both parents on the birth certificate before international travel.
